We represented a 44-year-old carpenter and his wife in this workplace injury and product liability action. The carpenter was an employee of Walsh Construction Company, contractor for "The Tides" luxury apartment complex in downtown Chicago. Walsh Construction was using a new safety product called the Tabla System (manufactured by A-1 Plank and Scaffolding and distributed by Midwest Access Services) to provide shoring on the project. While our client was at work, a panel of the Tabla System came unhinged and swung down, striking him in the back of the head and herniating two discs in his neck. He underwent a double fusion and the implanting of a pain pump to deliver medication. After documenting and presenting the product liability issues involved, we reached a settlement of more than $4 million with the construction company and the insurers of the Tabla System distributor and manufacturer. The settlement covers our client's past and future lost wages and his past and future medical expenses.
